TERMS OF SERVICE

1. About Parlay Posse

Parlay Posse ("we", "us", "our", or the "Service") is an online sports analytics and entertainment software platform operated as a software-as-a-service offering at parlayposse.com. The Service provides users with artificial-intelligence-powered analysis tools, statistical insights, parlay-construction utilities, and educational sports content.

WE ARE NOT A SPORTSBOOK, BOOKMAKER, BETTING EXCHANGE, GAMBLING OPERATOR, OR LICENSED GAMING ENTITY. We do not accept, place, settle, or process wagers of any kind. No money or anything of monetary value is wagered, won, or lost on Parlay Posse based on the outcome of any sporting event. Any actual betting activity occurs exclusively on third-party, independently operated, properly licensed sportsbooks where the user has their own account.

2. Acceptance of Terms

By creating an account, accessing, or otherwise using the Service, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional terms applicable to specific features. If you do not agree to these Terms, you must not use the Service.

3. Eligibility

You must be at least 21 years of age, or the legal age of majority in your jurisdiction (whichever is greater), to create an account or use any feature of the Service. By using the Service, you represent and warrant that (a) you meet this age requirement, (b) you are not located in a jurisdiction in which use of the Service is unlawful, and (c) you have not previously been suspended or banned from the Service.

4. Subscriptions and Marketplace Purchases

Pro Subscription. We offer recurring software subscriptions (monthly $9.99 USD; annual $79.99 USD) that grant access to premium analytical features. Subscriptions automatically renew at the end of each billing cycle until cancelled by you in your account settings. Cancellations take effect at the end of the current paid period; we do not offer pro-rated refunds for partial periods.

Marketplace Picks. Verified expert users may sell digital analytical content (parlay picks, write-ups, and reasoning) on our Marketplace as one-time purchases ranging from $1 to $25 USD. Parlay Posse facilitates these transactions and retains a platform commission of 20%; the remainder is paid out to the seller. Marketplace content is informational and educational only — purchase of a pick is not an investment, security, or wager and provides no guarantee of any sporting outcome or financial return.

Payment Processing. All payments are processed by Stripe. By submitting payment information, you authorize Stripe and Parlay Posse to charge the applicable amount to your designated payment method.

5. Refunds

Subscriptions: Non-refundable except where required by applicable law. You may cancel renewal at any time.

Marketplace Picks: All sales are final once the pick content has been delivered to you. Disputes regarding pick performance, accuracy, or game outcome are not grounds for refund.

Erroneous charges should be reported to support@parlayposse.com within 30 days for review.

6. User Conduct

You agree not to: (a) use the Service to facilitate, accept, or process wagers; (b) impersonate any person or misrepresent your affiliation; (c) reverse-engineer, scrape, resell, or republish our content or AI outputs without written permission; (d) interfere with the operation of the Service; (e) use the Service in violation of any law; or (f) provide picks or content you do not have the right to share.

7. No Guarantees — Entertainment Only

All analyses, picks, statistics, AI outputs, and editorial content provided through the Service are for informational and entertainment purposes only. Past performance does not guarantee future results. We make no representation or warranty regarding the accuracy, completeness, or outcome of any pick, parlay, prediction, or statistical model. You assume full responsibility for any decisions you make based on Service content.

8. Intellectual Property

The Service, including its software, design, branding, AI models, and aggregate data, is owned by or licensed to Parlay Posse and is protected by copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

You retain ownership of content you submit (e.g., picks you sell on the Marketplace) but grant Parlay Posse a worldwide, royalty-free, sublicensable license to host, display, and distribute that content as part of the Service.

9. Termination

We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms, suspected fraud, or any conduct that we deem harmful to the Service or its users. You may terminate your account at any time by contacting support@parlayposse.com or via the in-app delete-account flow.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARLAY POSSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Parlay Posse and its affiliates from any claim, damage, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party right.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice. Continued use of the Service after the effective date of any update constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, except where prohibited by law.
